MASTER TERMS OF SERVICE
Agricultural Feedstock Recovery & Transport

By signing up for or using Picky Pig services, the Picky Pig website, or a paper agreement, you (“Member” or “Client”) agree to the following Terms of Service (“Agreement”).
1. Nature of Picky Pig Services
Picky Pig provides agricultural feedstock recovery and transport services, consisting of the collection and delivery of source-separated food materials intentionally designated for direct agricultural use, including livestock feeding and soil production at farms and agricultural operations.
Picky Pig does not provide solid waste hauling, disposal, recycling, or composting services. Materials collected through Picky Pig services are not discarded, abandoned, or managed as waste at any point.
2. Material Designation & Intent
2.1 Designation at Source
By participating in Picky Pig services, Member expressly designates all food materials provided as agricultural feedstocks intended for productive reuse, not as discarded or waste materials.
2.2 No Discarded Materials
Member affirms that materials provided:
are intentionally separated for reuse,
are not disposed of or abandoned,
and are not intended for landfill, recycling, or composting facilities.
2.3 Ownership & Transfer
Member retains ownership of materials until delivery to the agricultural recipient, at which point materials are transferred for beneficial agricultural use.
3. Service Categories
3.1 Residential Pickup
Weekly or scheduled pickup of Member-provided feedstock containers at a designated location.
3.2 Commercial Service
Scheduled pickup of larger-volume feedstocks from businesses, kitchens, institutions, or organizations that intentionally designate materials for agricultural reuse.
3.3 Community Drop Off
Members may self-deliver up to 5 gallons per week to approved community drop-off locations using their assigned access code. Members must relock bins after use and help remove visible contamination if observed.
4. Kindness & Mutual Respect
Picky Pig rests on a foundation of kindness, mutual respect, and professionalism.
We treat all team members, customers, and partners with respect regardless of race, color, religion, belief, gender, identity, or otherwise. We expect the same from Members.
Picky Pig reserves the right to discontinue service and refund prorated membership fees if a Member behaves abusively, disrespectfully, or unprofessionally toward staff.
5. Communication
5.1 Email Communication
By signing up, Member agrees to receive service-related emails, including onboarding, service updates, and operational notices. Picky Pig does not sell or share email information with third parties.
6. Payments & Billing
Membership fees are billed monthly via credit/debit card or ACH.
Payments are processed securely through Stripe.
Members are responsible for maintaining current payment information.
7. Pickup Schedules & Timing
Pickups occur on assigned service days.
Pickup times are not guaranteed but generally occur between 9:00 AM – 5:00 PM.
Route adjustments may occur; reasonable advance notice will be provided whenever possible.
8. Weather & Safety
Picky Pig prioritizes team safety.
Service may be delayed or canceled due to:
extreme weather,
unsafe road conditions,
temperatures below 10°F, which may cause material freezing.
Picky Pig often follows local school district closures when making weather-related decisions and will notify Members as early as possible.
9. Missed Pickups
Missed pickups may occur due to mechanical failure, staff emergencies, or exceptional circumstances.
When feasible:
Members will be notified of delays or rescheduling.
Make-up service will be attempted as soon as possible.
Credits or refunds may be issued if an unreasonable inconvenience occurs.
10. Contamination & Feedstock Integrity
10.1 Prohibited Materials
Members may not include:
plastics,
non-compostable containers,
aluminum foil,
latex gloves,
produce stickers,
or other contaminants.
These materials pose serious risks to animals, farmers, and soil systems.
10.2 Education First
Picky Pig prioritizes education, coaching, and communication to prevent contamination.
10.3 Contamination Fees
After extended coaching and written notice:
Residential Members may be charged $5 per contamination incident.
Fees are assessed only after documented failure to resolve ongoing contamination.
11. Late Fees & Suspension
If payment fails:
Members will be notified to update payment information.
Service may be suspended if balance remains unpaid.
A late fee of 10% of the monthly membership fee may be assessed.
12. Regulatory Classification & Authority
The Parties agree that:
Services constitute agricultural feedstock recovery and transport
Picky Pig is not engaged in solid waste hauling
Materials are not delivered to regulated waste facilities
This Agreement does not establish a waste management relationship
Members agree to cooperate in confirming material designation if required.
13. Indemnification
Member agrees to indemnify and hold harmless Picky Pig from claims, penalties, or enforcement actions arising from:
misdesignation of materials,
inclusion of prohibited contaminants,
violations at the point of material generation.
14. Cancellation Policy
14.1 Timing
Members may cancel at any time before the next billing cycle to avoid further charges.
14.2 Notice
Cancellation requires at least 1 week notice prior to the next billing date. No next-day cancellations.
14.3 Fees
Membership fees are not prorated after billing.
15. Governing Law
This Agreement is governed by the laws of the State of Colorado, without regard to conflict of law principles.
16. Entire Agreement
This Agreement constitutes the entire understanding between the Parties and supersedes prior representations or agreements related to services.
17. Acceptance
By subscribing to the Service, Member agrees to these Terms of Service
